Contested divorces involving custody or property disputes generally range from $8,000–$25,000 or more, depending on how hard the opposing spouse fights and how complex the financial picture is.

About Your Case

Texas uses a specific percentage formula based on the paying parent's net monthly resources: 20% for one child, 25% for two, 30% for three, 35% for four, and 40% for five or more children. "Net resources" includes wages, salary, self-employment income, bonuses, and certain other sources, minus specific allowable deductions.

There is a cap on the amount of income used in the calculation, which is updated periodically by the Texas Attorney General. Texas doesn't use the word "custody" — we use "conservatorship." Joint managing conservatorship (JMC) is the legal default in Texas: both parents share decision-making rights about the child's education, healthcare, and religious upbringing.

Sole managing conservatorship (SMC) gives one parent exclusive rights to make these decisions — but it's only granted in specific situations, usually when there's been domestic violence, substance abuse, neglect, or a history that makes joint decision-making harmful to the child. Regardless of conservatorship type, the parent who has the child the majority of the time is called the "custodial parent" or "primary conservator," and typically determines the child's primary residence.

Probably not. Most Texas family law cases — even contested ones — settle out of court through negotiation or mediation. In fact, Texas courts now require mediation before trial in many counties, including Harris County.
